MAYN does not have terms of service yet, and inventing something that looked like a contract would be actively harmful - it would read as enforceable to everyone involved while covering none of the questions below. These terms must be drafted by a qualified attorney before the platform takes a real booking or moves any money.
What the terms have to settle
The list a drafting brief should start from.
Marketplace role and liability
Whether MAYN is a booking agent, a broker or a merchant of record, and how liability is allocated between platform, provider and renter for damage, injury, theft and third-party claims. This determines almost everything else.
Provider agreement
The contract between MAYN and each provider: insurance warranties, vehicle standards, honouring confirmed bookings, payout terms, indemnities, grounds for removal, and a non-circumvention clause covering customers introduced by the platform.
Renter agreement
Eligibility, licence and age requirements, the interaction between the provider's rental contract and the platform's terms, prohibited use, mileage overage, fuel and cleaning charges, and what happens after an accident.
Payments, deposits and refunds
Who holds funds and when, deposit authorisation and release, cancellation windows and refund entitlements, chargeback handling, and whether money transmission licensing applies to the chosen flow.
Insurance
Minimum commercial coverage required of providers, verification and re-verification, whether MAYN arranges supplementary protection, and exactly what is excluded. Insurance is where marketplaces of this kind most often fail.
California and local regulation
Rental car regulation in California, Los Angeles business licensing, airport permits for delivery to LAX and Burbank, disclosure requirements, and applicable consumer-protection rules.
Data, privacy and identity
Lawful basis and retention for identity documents and licence data, CCPA and CPRA obligations, third-party verification processors, and how message content retained for moderation is handled.
Disputes
Governing law, dispute resolution between renter and provider, the platform's role in adjudication, and arbitration or class-action provisions.
Until these exist, every booking on MAYN is an introduction between a customer and an independent provider, and the rental agreement is whatever that provider uses. See trust and safety for what the platform does and does not currently do.
